By accessing or using our website, submitting information through our website, making a contribution, registering for or participating in a program or event, volunteering with the Foundation, or otherwise engaging with The DS&P Foundation, Inc., you acknowledge and agree to these Terms of Use.

About The DS&P Foundation, Inc.

The DS&P Foundation, Inc. is a Florida nonprofit corporation recognized by the Internal Revenue Service as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code.

The Foundation operates for charitable and educational purposes with a mission focused on empowering women and girls, strengthening families, and advancing wellness, education, and community impact.

The Foundation’s activities may include educational initiatives, scholarship opportunities, community outreach, wellness and mental health awareness, family support, faith-centered service and encouragement, workshops, training and development programs, volunteer engagement, charitable assistance, community partnerships, fundraising activities, and other mission-aligned programs and initiatives.

Website Use

The DS&P Foundation, Inc. website and its content are provided for lawful, informational, educational, charitable, and community engagement purposes.

By using the website, you agree not to:

Charitable Contributions & Donations

Contributions to The DS&P Foundation, Inc. are voluntary and are used to support the Foundation’s charitable mission, programs, initiatives, operations, and activities.

Contributions may be tax-deductible to the extent permitted by applicable law. Donors should consult their own tax advisors regarding the tax treatment of individual contributions.

The DS&P Foundation, Inc. may provide donation acknowledgments or receipts in accordance with applicable legal and administrative requirements.

Unless otherwise required by law or expressly stated in writing, charitable contributions are generally nonrefundable.

Donor-Designated Contributions

The DS&P Foundation, Inc. may provide opportunities for donors to express a preference that their contributions support a particular program, initiative, campaign, scholarship fund, or charitable purpose.

The Foundation will make reasonable efforts to honor donor preferences consistent with applicable law, charitable purposes, organizational needs, and any terms communicated at the time of the contribution.

Unless a contribution is accepted subject to a legally binding restriction, The DS&P Foundation, Inc. retains appropriate discretion and control over the use of contributed funds in furtherance of its charitable mission.

Programs, Events & Community Activities

Participation in Foundation programs, events, workshops, community outreach activities, wellness initiatives, educational opportunities, and other activities is voluntary.

Participants are expected to conduct themselves respectfully, responsibly, safely, and in a manner consistent with the mission and values of The DS&P Foundation, Inc.

The Foundation reserves the right to establish and enforce reasonable participation requirements, safety guidelines, eligibility criteria, codes of conduct, and other standards necessary to protect participants, volunteers, staff, representatives, programs, and the integrity of the organization.

Disruptive, threatening, abusive, discriminatory, harassing, unlawful, unsafe, or otherwise inappropriate behavior may result in restricted participation or removal from a program, event, activity, or Foundation-related space.

Volunteer Participation

Volunteers play an important role in supporting the charitable mission of The DS&P Foundation, Inc.

Volunteer participation may be subject to applications, agreements, training, background screening, confidentiality requirements, codes of conduct, safety procedures, or other requirements depending on the nature of the volunteer role.

Unless otherwise established through a written employment agreement, participation as a volunteer does not create an employment relationship with The DS&P Foundation, Inc.

Volunteers are expected to follow applicable Foundation policies, procedures, instructions, safety requirements, and standards of conduct.

Scholarships, Educational Opportunities & Charitable Assistance

The DS&P Foundation, Inc. may offer scholarships, educational opportunities, charitable assistance, community resources, and other forms of mission-aligned support.

Eligibility requirements, application procedures, selection criteria, deadlines, award amounts, restrictions, and other terms may vary by program or initiative.

Submitting an application or request does not guarantee selection, funding, assistance, participation, or an award.

The DS&P Foundation, Inc. reserves the right to review applications and determine eligibility and awards in accordance with applicable program requirements, organizational policies, available resources, charitable purposes, and applicable law.

Photography, Video & Media

Photography, video recording, interviews, or other media capture may occur during Foundation events, programs, volunteer activities, community outreach initiatives, and other activities.

Any use of an individual’s name, image, likeness, voice, testimonial, or other media for promotional, educational, editorial, fundraising, or organizational purposes will be governed by applicable notices, consent requirements, releases, agreements, and laws.

Participants with questions or concerns regarding photography or media use should contact The DS&P Foundation, Inc. before participating in an applicable event or activity.

Educational & Informational Content

Information and resources provided through The DS&P Foundation, Inc. website, programs, events, publications, social media channels, workshops, communications, and other activities are provided for general informational, educational, charitable, and community engagement purposes.

Foundation content is not intended to replace individualized medical, mental health, legal, financial, tax, or other professional advice.

Individuals should consult appropriately qualified professionals regarding decisions related to their individual circumstances.

Intellectual Property

Names, logos, trademarks, original written content, educational materials, program materials, graphics, photographs, videos, publications, designs, and other intellectual property associated with The DS&P Foundation, Inc. are owned or lawfully used by The DS&P Foundation, Inc. or the applicable legal rights holder.

Nothing on The DS&P Foundation, Inc. website, within its programs, at events, or in organizational materials grants any individual or organization an ownership interest or other right to use protected intellectual property except as expressly authorized in writing or otherwise permitted by applicable law.

Unauthorized reproduction, distribution, modification, publication, commercial use, or exploitation of protected materials is prohibited except as otherwise permitted by applicable law.

Relationship to Diamond, Sapphire & Pearl Ladies LLC

The DS&P Foundation, Inc. is a separate legal entity from Diamond, Sapphire & Pearl Ladies LLC, publicly known as DS&P Ladiesâ„¢ | The House of Gemzâ„¢.

Each organization maintains its own legal identity, governance, operations, finances, programs, activities, and responsibilities.

Nothing in these Terms of Use should be interpreted as merging the legal identities, assets, liabilities, contractual obligations, or operations of The DS&P Foundation, Inc. and Diamond, Sapphire & Pearl Ladies LLC.

Any authorized collaboration, shared initiative, or use of intellectual property between the organizations is subject to applicable agreements, permissions, policies, and laws.

Third-Party Websites & Services

The Foundation website, communications, programs, events, and activities may include links to or involve independent third-party websites, platforms, payment processors, fundraising platforms, venues, service providers, professionals, organizations, or other resources.

The DS&P Foundation, Inc. does not control independent third-party providers and is not responsible for their content, availability, security, privacy practices, policies, acts, omissions, or performance.

Individuals are encouraged to review the applicable terms and policies of third-party providers before using their services or providing personal information.

Assumption of Risk & Limitation of Liability

Participation in Foundation programs, events, volunteer activities, community initiatives, wellness activities, and other offerings may involve ordinary and inherent risks.

By voluntarily participating, individuals acknowledge and accept the ordinary and inherent risks associated with their chosen activities and participation.

To the extent permitted by applicable law, The DS&P Foundation, Inc. and its directors, officers, authorized representatives, volunteers, and agents are not responsible for losses, injuries, damages, delays, disruptions, or expenses arising from circumstances beyond their reasonable control or from the acts or omissions of independent third-party providers.

Nothing in these Terms of Use is intended to waive, restrict, or exclude any rights or liabilities that cannot lawfully be waived, restricted, or excluded under applicable law.

Privacy

Information collected through The DS&P Foundation, Inc. website, donation forms, applications, registrations, programs, events, volunteer activities, and other interactions is handled in accordance with the Foundation’s applicable Privacy Policy and other organizational policies.
