The DS&P Foundation, Inc.

The DS&P Foundation, Inc. uses photography, video, audio recordings, interviews, testimonials, and other forms of media to document and communicate its charitable mission, programs, events, community impact, educational initiatives, volunteer activities, fundraising efforts, and organizational accomplishments.
This Media Release & Consent Policy explains the terms governing the capture and authorized use of an individual’s name, image, likeness, voice, statements, testimonials, participation, and other media content.
By knowingly and voluntarily providing consent through an applicable registration form, participation agreement, media release, authorization, or other consent process, individuals acknowledge and agree to the terms applicable to the authorized collection and use of media.
Permission to Capture & Use Media
When appropriate consent has been provided, individuals authorize The DS&P Foundation, Inc. and its authorized representatives to photograph, film, record, interview, or otherwise capture their:
💙 Name.
💙 Image and likeness.
💙 Voice.
💙 Statements and interviews.
💙 Testimonials.
💙 Participation in Foundation programs, events, volunteer activities, community outreach initiatives, and other activities.
💙 Photographs, video recordings, audio recordings, and other related media content.
Subject to applicable law and the terms of any specific consent or release, The DS&P Foundation, Inc. may use authorized media in furtherance of its charitable, educational, fundraising, outreach, and community impact purposes.
Authorized Uses
Authorized media may be used in connection with:
💙 The DS&P Foundation, Inc. website.
💙 Social media platforms and digital communications.
💙 Newsletters and email communications.
💙 Printed publications and promotional materials.
💙 Educational resources and presentations.
💙 Program and event communications.
💙 Volunteer recruitment and recognition.
💙 Fundraising campaigns and donor communications.
💙 Grant applications, reports, and impact documentation.
💙 Annual reports and community impact materials.
💙 Press releases, media relations, and public relations activities.
💙 Other legitimate charitable, educational, promotional, historical, and organizational purposes consistent with the Foundation’s mission.
Editing, Reproduction & Distribution
Individuals who provide appropriate media consent authorize The DS&P Foundation, Inc., subject to applicable law and the terms of the applicable release, to edit, reproduce, publish, display, distribute, archive, and otherwise use authorized photographs, recordings, and other media.
Media may be edited for length, clarity, formatting, design, accessibility, or other legitimate organizational purposes.
The Foundation will not knowingly use authorized media in a manner intended to falsely portray, defame, or materially misrepresent an individual.
Ownership of Foundation-Created Media
Subject to applicable law and any governing agreements, photographs, videos, audio recordings, graphics, publications, and other media created or commissioned by The DS&P Foundation, Inc. may be owned by the Foundation or the applicable legal rights holder.
Participation in a photograph, video, recording, interview, event, program, or other activity does not, by itself, grant an individual ownership rights in Foundation-created media.
Nothing in this Policy is intended to claim ownership of preexisting intellectual property or independently created content belonging to participants, photographers, videographers, contractors, vendors, or other third parties.
Ownership of such materials will be determined according to applicable law and any governing written agreements.
No Right of Prior Inspection or Approval
Unless otherwise expressly agreed in writing, individuals who provide media consent waive the right to inspect or approve final photographs, videos, recordings, edits, captions, layouts, designs, publications, or other authorized uses before publication or distribution.
The DS&P Foundation, Inc. retains reasonable editorial discretion regarding the selection, editing, presentation, and authorized use of Foundation-created or lawfully obtained media.
No Compensation
Individuals understand that no payment, royalty, fee, or other compensation will be provided for authorized use of their name, image, likeness, voice, statements, testimonials, participation, or related media unless otherwise expressly agreed in writing.
Authorized use of such media supports the charitable, educational, fundraising, outreach, and community impact mission of The DS&P Foundation, Inc.
Testimonials & Personal Statements
The DS&P Foundation, Inc. may request permission to use testimonials, interviews, personal statements, stories, or other voluntarily provided content.
The Foundation may edit such content for length, grammar, clarity, formatting, or presentation while making reasonable efforts to preserve the substance and meaning of the individual’s statement.
Sensitive personal information will be handled in accordance with applicable privacy practices, permissions, organizational policies, and laws.
Withdrawal of Consent
Individuals may submit a written request to withdraw previously provided media consent by contacting The DS&P Foundation, Inc.
Withdrawal requests will apply to future uses where reasonably practicable after the Foundation receives and processes the written request.
Withdrawal of consent does not require the Foundation to recall, destroy, remove, or discontinue materials that were lawfully created, published, printed, distributed, archived, submitted, incorporated into reports or publications, or otherwise used before the withdrawal request was received and processed.
The Foundation will make reasonable efforts to address future use requests consistent with applicable law, contractual obligations, technological limitations, administrative feasibility, and organizational requirements.
Events & Group Photography
Photography, video recording, or other media capture may occur during Foundation events, programs, workshops, volunteer activities, community outreach initiatives, and other gatherings.
When reasonably appropriate, The DS&P Foundation, Inc. may provide notices regarding photography or recording activities.
Individuals with concerns regarding photography or media participation are encouraged to contact a Foundation representative before participating in the applicable activity.
Specific programs, activities, or events may require additional media releases or consent procedures.
Minors
When a participant is under the age of 18, media consent must be provided by a parent or legal guardian when required by applicable law or Foundation policy.
The DS&P Foundation, Inc. may establish additional authorization, consent, privacy, and media procedures for programs, activities, or initiatives involving minors.
The Foundation reserves the right to limit the collection, publication, or use of identifying information concerning minors when reasonably appropriate to protect their privacy, safety, and well-being.
Privacy & Personal Information
Personal information collected in connection with media consent, releases, programs, events, and Foundation activities will be handled in accordance with The DS&P Foundation, Inc. Privacy Policy and other applicable organizational policies and legal requirements.
Third-Party Media
Independent photographers, videographers, news organizations, event partners, venues, community organizations, or other third parties may capture media during certain activities.
The DS&P Foundation, Inc. does not control the independent privacy, media, or intellectual property practices of unaffiliated third parties.
When the Foundation engages photographers, videographers, contractors, or other service providers to create media on its behalf, the applicable ownership, usage, confidentiality, and other rights should be governed by appropriate agreements when necessary.
Relationship to Diamond, Sapphire & Pearl Ladies LLC
The DS&P Foundation, Inc. is a separate legal entity from Diamond, Sapphire & Pearl Ladies LLC, publicly known as DS&P Ladies™ | The House of Gemz™.
Media collected by or on behalf of The DS&P Foundation, Inc. is governed by applicable Foundation policies, permissions, releases, agreements, and laws.
Nothing in this Policy automatically grants Diamond, Sapphire & Pearl Ladies LLC ownership of or unrestricted rights to Foundation media.
Any authorized sharing or use of media between The DS&P Foundation, Inc. and Diamond, Sapphire & Pearl Ladies LLC should be consistent with applicable permissions, agreements, organizational policies, and laws.
Changes to This Policy
The DS&P Foundation, Inc. reserves the right to update or modify this Media Release & Consent Policy as its programs, operations, media practices, technology, or applicable requirements evolve.
Updated versions may be posted on the Foundation website with a revised effective date.
